
SEC Set to Vote on "Regulation Crypto" — Its First Formal Crypto Rulemaking
The U.S. Securities and Exchange Commission has scheduled an open meeting for Friday, August 14, 2026, at 10:00 a.m. ET. There is a single item on the agenda: whether to propose new rules creating a tailored offering regime for certain investment contracts involving crypto assets — informally known as "Regulation Crypto." The meeting will be held at SEC headquarters in Washington and webcast on sec.gov.
This is the first formal crypto rulemaking of Chairman Paul Atkins' tenure. Until now, the agency's crypto posture has rested on staff statements and policy guidance, which a future Commission could reverse. Notice-and-comment rulemaking creates durable, binding rules.
Based on the framework Atkins outlined earlier this year, the proposal is expected to give qualifying crypto projects a path to raise capital without triggering full securities registration, and potentially an exit route from SEC jurisdiction once a network is no longer actively managed by a central team. Analysts have suggested it may begin with a safe harbor for early-stage token sales. The actual text is not public until Friday.
A yes vote on Friday does not create a rule. It publishes the proposal for public comment, opening a rulemaking process, with final adoption realistically in 2027. The vote comes as the CLARITY Act market-structure bill remains stalled in the Senate.
What token issuers, funds, and fintech companies should do now is review pending or planned token offerings against the proposal once published, and consider participating in the comment period, where well-argued industry input genuinely shapes final rules.
